A.C.: Takes props for predicting the Roberts as chief buzz.
D.L.: The media spin is dead on. Roberts was mentored by Rehnquist. His legacy will be the same...a minimalist court.
A.C.: Only three Chief Justices are remebered as significant (Marshall, Taney and Warren.) Rhenquist did shape the court by reducing its case load. That is Federalism...restricting the role of federal courts in shaping state law.
D.L.: Poppycock...when history looks at Rehnquist's biggest case (Bush v. Gore) he can out against state's rights. He was a disaster as C.J.
A.C.: Warren Burger was a disaster as C.J. Rehnquist did what a C.J. has to do--keeping control of the Court's process of releasing opinions. You're expecting the man to live up to the hype of the title "Chief Justice." In the end, a Chief Justice is just one of nine USSC justice votes. (First among equals.) His greatest power is that of an administrator who simply manages the paperwork of the federal judiciary. In otherwords, his greatest responsibility is a bureaucrat.
D.L.: I can't wait to see him perform under pressure at the Senate hearing (starts Monday.) We'll learn quickly if his book smarts also translate into political smarts. He better have the political smarts to operate in the USSC conference in which the justices share their views on each case in private quarters. He's a young guy coming into an exclusive club. The hearings will show if this guy will get pushed around by the heavyweights on the court.
A.C.: Speaks highly of Roberts' character-- a family guy, a true geek who has a renowned knowledge of pop culture.
D.L.: So Sen. Specter's first question from the Judiciary Committee will be about Gwenn Stefani?
A.C.: He's as normal as you're going to get in a high-powered post.
D.L.: Trust me on this. He'll be a big mistake in 5 years. Too cautious. I want to hear him give saucy answers next week instead of dodging the tough ones.
P.M.: I bet Taney gave some saucy answers at his confirmation.
A.C.: You're expecting the Chief Justice to be #6 on your superheroes list. It's unrealistic!
D.L.: List one amazing decision that he wrote.
A.C.: You're point is moot.
J.B.: I love how they are now naming Rehnquist as a judicial acitivist.
D.L.: I reiterate my point on Bush v. Gore.

This topic is unbloggable, so im going to add my own tid-bit on the election of the next supreme court justice. I was personally thinking of Kanye West, but then i remembered "Bush hates black people." What a comment, i still can't believe it.

It's not related to this blog entry, but I have a comment about FEMA. Mr. Coneen, you posed the question of where were the "horse racing" allegations against Mike Brown when the hurricanes hit Florida. I'll give his agency credit for handling those disasters well. But those allegations appeared because FEMA, under his leadership, mishandled this disaster. I cite a recent CNN report in which his agency confused Charleston, South Carolina with Charleston, West Virginia. And that's just the surface. My guess is that Rhenquist will be remembered for being the only chief justice to die while another justice's position was trying to be filled. The Bush/Gore thing might be remembered too, but like one of you said, the chief justice isn't that much more important than the other 8 justices. I wonder what Bush's legacy will be like now. Will he be remembered as the guy who screwed up the Katrina situation, or can he redeem himself? (Personally, I don't even think it's all his fault, he's one man and he's got a lot of advisers who could be giving him bad advice). I also wonder if this will affect the next presidential election, or even the next congressional election. Will there be a rise in democratic officials? (*hopefully, haha*)
